Subject: Public Holidays

Retro-active compensation for public holidays for the period July 1997 to May 2003


The Court of First Instance of 7 May 2003 in its ruling (Case T-23/01 Kimman v Commission) revoked Commission Decision of 17 July 1997 (Decision No E/1997/1051). As a direct result officials serving in third countries were entitled to all public holidays of the place of posting as from 7 May 2003.

Furthermore it has been decided to grant compensation of 2 days per full year of service or 1 day per half year of service to all officials who served in the delegations in third countries between the period July 1997 and May 2003. A total/maximum of 11 days can in this way be obtained.

Officials are requested to complete the attached form  giving details of the delegations in which they served and the exact dates of the posting. These forms must be signed by the Head of Delegation and sent to Relex K-2 by the Head of Delegation before 15 February 2004. Officials will be granted the compensation days with their 2004 annual leave entitlement.

No compensation days will be granted to officials who do not complete the relevant form.
