Luxembourg, 7th April 2004
CONCLUSION 231/04
APPROVED BY THE HEADS OF ADMINISTRATION BY WRITTEN PROCEDURE ENDED ON 7th
APRIL 2004
Subject:
|
Presence of a person chosen by an
official to assist him or her at a preliminary hearing as provided for
by Article 3 of Annex IX to the Staff Regulations |
SEC(2004)511
Article 4, Article 13(3) and Article 16(1) of Annex IX to the Staff
Regulations allow officials involved in disciplinary proceedings to be
represented or assisted by a person of their choice.
However, Article 3 of Annex IX to the Staff Regulations requires the
appointing authority to hear the person concerned before initiating the
disciplinary proceedings. The Heads of Administration conclude that
officials may be assisted by a person of their choice at the preliminary
hearing provided for in Article 3 of Annex IX to the Staff Regulations.
This Conclusion shall apply from 1 May 2004.
It repeals and replaces Conclusion 103J/77 of 18 March 1977.
