Subject:      Presence of a person chosen by an official to assist him or her at a preliminary hearing as provided for by Article 3 of Annex IX to the Staff Regulations

On 7 April 2004 the College of the Heads of Administration approved by written procedure Conclusion 231/04 (see annex), which is applicable within the Commission from 1 May 2004.

Subject:      Presence of a person chosen by an official to assist him or her at a preliminary hearing as provided for by Article 3 of Annex IX to the Staff Regulations

Article 4, Article 13(3) and Article 16(1) of Annex IX to the Staff Regulations allow officials involved in disciplinary proceedings to be represented or assisted by a person of their choice.
 
However, Article 3 of Annex IX to the Staff Regulations requires the appointing authority to hear the person concerned before initiating the disciplinary proceedings. The Heads of Administration conclude that officials may be assisted by a person of their choice at the preliminary hearing provided for in Article 3 of Annex IX to the Staff Regulations.
 
This Conclusion shall apply from 1 May 2004.
 
It repeals and replaces Conclusion 103J/77 of 18 March 1977.
