COMMISSION DECISION

on the adjustment of the weightings and corresponding exchange rates referred to in Articles 12 and 13 of Annex X to the Staff Regulations

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Staff Regulations of officials and the Conditions of Employment of other servants of the European Communities, as laid down in Council Regulation (EEC, EURATOM, ECSC) No 259/68 ⁽¹⁾, and in particular Articles 12 and 13 of Annex X to the Staff Regulations,
Whereas new provisions should be adopted regarding the adjustment of weightings and the corresponding exchange rates,

HAS DECIDED AS FOLLOWS:

Article 1

The weighting and corresponding exchange rate referred to in Article 12 of Annex X shall enable the purchasing power of the net remuneration expressed in euro and payable, in whole or in part, in the currency of the country of employment or in another currency, to be preserved.

Article 2

The weighting for the capital city of a country of employment shall apply for all locations in that country unless a separate weighting is laid down for the place of employment concerned.

Article 3

The weightings and corresponding exchange rates for the various places of employment shall, in accordance with the first paragraph of Article 13 of Annex X to the Staff Regulations, be laid down once a year by the Council on the basis of proposals put forward by the Commission.

Article 4

In the case referred to in the second paragraph of Article 13 of Annex X to the Staff Regulations, the Appointing Authority shall make the necessary intermediate adjustments and, where applicable, apply them retroactively.

Article 5

The corresponding exchange rates used shall be the rates laid down in accordance with the detailed rules for the implementation of the Financial Regulation on the date of application of the weighting.

Article 6

These provisions shall enter into force on 1 May 2004.

They repeal and replace the Internal Directives on the adjustment of the weightings and corresponding exchange rates referred to in Articles 12 and 13 of Annex X to the Staff Regulations that entered into force on 10 October 1987.
