COMMISSION DECISION

concerning the application of article 22 of annex X to the staff regulations of officials on recovery of the temporary accommodation allowance and the cost of transport of the personal effects of the spouse and dependants

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Communities laid down in Council Regulation (EEC, Euratom, ECSC) No 259/68⁽¹⁾ , and in particular Article 22 of Annex X to the Staff Regulations,

Whereas Article 22 of Annex X to the Staff Regulations, on recovery of the temporary accommodation allowance and the cost of transporting the personal effects of the spouse and dependants, should be clarified,

HAS DECIDED AS FOLLOWS:

Article 1

In accordance with Article 22 of Annex X to the Staff Regulations, in the event of a probationer official not being established, the institution may in exceptional cases recover the following percentages of the temporary accommodation allowance and cost of transporting the personal effects of the spouse and dependants:

• 50 % if the probationary period is brought to a close in the first three months;
   

• 40 % if the probationary period is brought to a close between the third and the sixth month;
   

• 10 % if the probationary period is brought to a close after the sixth month.

In the case of a six month probationary period the periods applicable shall be two months and four months respectively.

Article 2

These provisions shall apply by analogy to temporary staff and contract staff.

Article 3

These provisions shall enter into force on 1 May 2004.

It repeals and replaces the Internal Instruction for applying Article 22 of Annex X to the Staff Regulations of Officials of the European Communities concerning recovery of the temporary accommodation allowance and the cost of transporting the personal effects of the spouse and dependants which entered into force on 10 October 1987.
