AMENDING THE RULES GOVERNING SPECIAL ADVISERS

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Communities laid down in Council Regulation (EEC, EURATOM, ECSC) No 259/68(1), and in particular Articles 5, 123 and 124 of the Conditions of Employment of Other Servants,

Having regard to the Rules Governing Special Advisers to the Commission of 14 March 2000(2), as last amended by the Commission Decision of 2 October 2002(3),

Whereas the Rules Governing Special Advisers to the Commission, in particular the remuneration levels referred to therein, should be amended so as to correspond to the grades in the new system of careers defined in Regulation (EC, EURATOM) No 723/2004,

HAS DECIDED AS FOLLOWS:

Article 1

The Rules Governing Special Advisers to the Commission are hereby amended as follows:

  1. The last paragraph of the Section entitled “Definition of special advisers” is replaced by the following:

    “These Rules shall not apply to Special Advisers to the Commission covered by other specific Commission Decisions and remunerated from appropriations specifically intended for that purpose.”
     

  2. The first indent in the Section entitled “Remuneration of Special Advisers” is replaced by the following:

    “- set the amount of the fees per day of service at three separate levels: €410, €325 and €2801. However, the Commission may depart from these levels in duly substantiated exceptional cases. The level at which advisers are placed shall be determined by the Member of the Commission in the light of the duties they are expected to perform;”

    1 The three levels correspond to 1/22 (22 being the average number of working days per month) of the basic salary of an official on the first step in grades:

    • A*12, A*10 and A*9 respectively from 1 May 2004 to 30 April 2006 ;

    • AD 12, AD 10 and AD 9 from 1 May 2006.”

Article 2

This Decision shall take effect on the day of entry into force of Regulation (EC, EURATOM) No 723/2004.
