Discipline

1. The number of disciplinary procedures brought to a conclusion in 1997 was seven. They concerned :

  • 2 officials in Category B
  • 2 officials in Category C
  • 3 officials in Category D
Three cases were referred to the Disciplinary Board.

2. The offences were :

Forgery 1
Breaches of Articles 12 and 17 of the Staff Regulations1
Theft of Commission property 2
Acts of commission and Omission in connection with the disappearance of Commission property1
Incompetence1
Failure to comply with the rules for the election of the Staff Committee1

3. The following penalties were ordered :

5. Number of proceedings under way as at 31 January 1998 :

  • 22 disciplinary proceedings
  • 4 administrative inquiries

N.B.

Staff are reminded that the opening of disciplinary proceedings does not automatically imply that the person under investigation is guilty.
Offences in respect of which action has been initiated must be proved in the course of the proceedings. Where in the case of apparently serious offences no action has been taken or only minor penalties have been imposed, it is because investigations showed that the charges were in whole or part without foundation.
The reason why other cases were closed without any action being taken, despite evidence that the offence had been committed, is that the person charged had health problems sufficiently serious to require medical treatment and preclude disciplinary action.
