FLEMISH SOCIAL CARE INSURANCE



The Flemish social care insurance scheme (Vlaamse zorgverzekering) will enter into force on 1 October 2001 (see www.vlaamsezorgverzekering.be). This insurance scheme is an initiative of the Flemish authorities in Belgium with a view to partially covering non-medical expenses incurred by persons heavily dependent on the assistance of others.

Anyone residing in Flanders, registered in the national register, and over 25 years of age, will be required to pay the fixed rate of contribution. The inhabitants of the Brussels Capital region have the possibility of joining on a voluntary basis. Social care funds (Zorgkassen) (mutual insurance companies, DKV, SMAP/OMOB and the Flemish social care fund - Vlaamse zorgkas) will be responsible for organizing this insurance scheme.

As from 1 October 2001, these people have to register with a recognized social care fund. Those in Flanders who have not registered by 31 December 2002 at the latest will automatically be affiliated to the Vlaamse zorgkas.

The contribution for the period between 1 October 2001 and 31 December 2002 has been fixed at 10 . The annual contribution as from 1 January 2003 will be linked to the affiliated member's level of income, in particular his or her professional income.

ADVICE TO EUROPEAN OFFICIALS RESIDING IN FLANDERS OR BRUSSELS

The Central Office of the Joint Sickness Insurance Scheme (JSIS) considers that the social care insurance scheme covers national insurance benefits for the purposes of Article 15 of the Protocol on the Privileges and Immunities of the European Communities, which provides for the establishment of its own scheme of social security benefits. Affiliation to the Flemish insurance scheme for officials (including pensioners) and temporary servants as well as dependent spouses not engaging in a professional activity should not therefore be mandatory.

The authorities of the Flemish Community do not agree with this interpretation and the matter has been referred to the Legal Service of the Commission so as to clarify the situation, in particular as regards the requirement of affiliation.

Pending more precise information on this matter and in view of the time-limit for paying the annual contribution (until 31 December 2002), the Central Office advises all those concerned not to join a social care fund (Zorgkas) for the time being. Also, it is not clear whether officials who wish to take out a policy with this scheme on a private and voluntary basis would subsequently be able to qualify for benefits.
