LISTE POUR DEGAGEMENT - TRANCHE 2002

The Commission, on 17 December 2002, adopted a decision implementing Council Regulation (EC, Euratom) No. 1746/2002. This decision contains special measures to terminate, in the round 2002, the service of officials of the European Communities appointed to an established post in the European Commission. After the expiry of the period for withdrawal referred to in Article 5 of the decision, the final list of selected candidates has been established. Both, the decision and the final list are presented hereunder in accordance with Article 9(1) of the Commission decision of 16 October 2002 (Administrative Notice No 85 - 2002).

Implementing Council Regulation (EC, Euratom) No. 1746/2002 introducing, in the context of the reform of the Commission, special measures to terminate the service of officials of the European Communities appointed to an established post in the Commission of the European Communities - round 2002

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EC, EURATOM) No. 1746/2002 of 30 September 2002 introducing, in the context of the reform of the Commission, special measures to terminate the service of officials of the European Communities appointed to an established post in the Commission of the European Communities ¹, and in particular Article 1 thereof,

Having regard to the Commission Decision of 16 October 2002 ²implementing Council Regulation (EC, EURATOM) No. 1746/2002 of 30 September 2002,

Whereas:

Some officials of the European Communities, appointed to an established post in the Commission of the European Communities have, upon their application, been selected for termination of their service, within the meaning of Article 47 of the Staff Regulations,
This selection has been carried out within the framework of the measures set out in Council Regulation (EC, EURATOM) No. 1746/2002 of 30 September 2002, and in the Commission Decision of 16 October 2002,
The Commission has decided to implement these measures in three rounds, in 2002, 2003 and 2004 respectively,
A list of such officials to whom such measures apply shall be drawn up,
The Joint Committee has been consulted in respect of the officials appearing on the list,
The Commission shall adopt such a list,
These officials shall be informed of their inclusion in the list,
The date of departure of a selected official should be fixed by the Director General for Personnel and Administration, in consultation with the official's Director General, or Head of service,
The fixing of the date of departure of a selected official shall take into account the requirement that the average allowance not exceed 62,5% of the last basic salary, as set out in Article 6(3)(f) of the Commission Decision of 16 October 2002,
An official so selected should have the opportunity, within a set time limit, to withdraw their name from the list, as set out in the Commission Decision of 16 October 2002,
In each round the selection of officials undertaken within the framework of the measures set out in Council Regulation (EC, EURATOM) No. 1746/2002 of 30 September 2002, and in the Commission Decision of 16 October 2002, will be done on a comparative basis, using the criteria laid down in these two documents. The selection, or non-selection of an official during one round does not create any precedent for the following rounds,
For this round there is no reserve list of officials who will be selected in the case of withdrawal of an official from the list,

HAS DECIDED AS FOLLOWS:

Article 1
List of Officials
Annex 1 to this Decision sets out the names and personnel numbers of those officials who have been selected for termination of their service, within the meaning of Article 47 of the Staff Regulations, in the framework of the measures set out in Council Regulation (EC, EURATOM) No. 1746/2002 of 30 September 2002, and in the Commission Decision of 16 October 2002 implementing this regulation.

Article 2
Date of departure of selected officials
The Director General for Personnel and Administration, in consultation with the official's Director General or Head of service will fix the date of departure of an official. The date of departure so fixed shall be no later than 30 June 2003. The requirement that the average allowance of the officials selected in this round should not exceed 62,5% of their last salary is one of the factors in determining the date of departure of an official.

Article 3
Independence of each round
The presence or absence of an official from the list referred to in Article 1 of this decision does not set any precedent for subsequent rounds.

Article 4
No reserve list
No reserve list has been adopted for this round.

Article 5
Withdrawal by official from the list
The officials appearing on the list referred to in Article 1 shall be informed of their selection in writing. They shall have a period of 10 working days from notification, during which they may withdraw their application. Candidates whose names do not appear on the list will be informed in writing that their application was not successful.
