COMMISSION DECISION

amending its decision of 28 April 2004 on the exercise of powers conferred by the Staff Regulations on the Appointing Authority and by the Conditions of Employment of Other Servants on the Authority Responsible for Concluding Contracts of Employment (COM(2004)1606)

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to Article 2(1) of the Staff Regulations of Officials of the European Communities,

Having regard to Article 6 of the Conditions of Employment of Other Servants,

Whereas

1. The exercise of powers of the appointing authority and the authority responsible for concluding contracts of employment in respect of heads of representation should be defined following the Commission's decision of 7 July 2004 (C(2004)2662).
    

2. The powers of the appointing authority and the authority responsible for concluding contracts of employment in respect of staff of grade AD 14 should be rationalised and the powers exercised in respect of the Director of OLAF should be specified.
    

3. The Commission decision of 28 April 2004 on the exercise of powers conferred by the Staff Regulations on the Appointing Authority and by the Conditions of Employment of Other Servants on the Authority Responsible for Concluding Contracts of Employment (COM(2004)1606)⁽¹⁾ should be amended accordingly and, in the interests of legal certainty, the Commission's decision of 30 June 2004 (C(2004)2286) should be repealed,

HAS DECIDED AS FOLLOWS:

Article 1

Tables III  "Career" in Annex I (Staff paid from the administrative appropriations and staff paid from the research and technological development appropriations serving in the Directorates-General for Enterprise and for the Information Society) and Annex II (Staff paid from the research budget other than those serving in the Directorates-General for Enterprise and for the Information Society) and Table XI "Temporary staff" in Annex I to Commission Decision of 28 April 2004 on the exercise of powers conferred by the Staff Regulations on the Appointing Authority and by the Conditions of Employment of Other Servants on the Authority Responsible for Concluding Contracts of Employment are hereby replaced by the Tables in the Annex to this Decision.

Article 2

Tables VI "Discipline (administrative investigation, disciplinary procedure) and personal liability in cases of serious misconduct" in Annex I (Staff paid from the administrative appropriations and staff paid from the research and technological development appropriations serving in the Directorates-General for Enterprise and for the Information Society), Annex II (Staff paid from the research budget other than those serving in the Directorates-General for Enterprise and for the Information Society) and Annex III (Staff of the Anti-Fraud Office (OLAF)) to Commission Decision of 28 April 2004 on the exercise of powers conferred by the Staff Regulations on the Appointing Authority and by the Conditions of Employment of Other Servants on the Authority Responsible for Concluding Contracts of Employment are hereby replaced by the Tables in the Annex to this Decision.

Article 3

This Decision shall enter into force on the day of its adoption. It repeals the Commission Decision of 30 June 2004 (C(2004) 2286) amending the Commission Decision of 28 April 2004 (COM(2004) 1606).
