Commission decision of 21 January 1998



THE EUROPEAN COMMISSION,

Having regard to Article 2 of the Staff Regulations of Officials of the European Communities,

Having regard to Article 6 of the Conditions of Employment of Other Servants,

Whereas on 20 November 1985 the Commission adopted a Decision on the exercise of the powers conferred by the Staff Regulations on the appointing authority and by the Conditions of Employment of Other Servants on the authority responsible for concluding contracts of employment;

Whereas account should be taken, where necessary, of the decisions adopted by the Commission since 20 November 1985 on the coordination and management of its departments, on middle-management policy and on various reorganisation measures;

Whereas the Commission Decision of 16 January 1996 on the organisation chart for the Joint Research Centre made it an independent Directorate-General of the Commission;

Whereas the Commission Decision of 10 April 1996 on the reorganisation of the Joint Research Centre delegated to the Director-General of the JRC a number of powers, including those conferred by the Staff Regulations on the appointing authority and by the Conditions of Employment of Other
Servants on the authority responsible for concluding contracts of employment;

Whereas account should also be taken of the amendments made to the Staff Regulations and to the Conditions of Employment of Other Servants;

Whereas on 24 September 1997 the Commission decided, within the framework of the Modernisation of Administration and Personnel Policy for the year 2000, that a number of measures should be taken to simplify and decentralise staff management decisions and procedures;

Whereas the powers of the appointing authority should therefore be updated and consolidated to take account of all the changes made since the Commission Decision of 20 November 1985,

HAS ADOPTED THIS DECISION:

Article 1

The powers conferred by the Staff Regulations on the appointing authority and by the Conditions of Employment of Other Servants on the authority responsible for concluding contracts of employment in respect of staff paid from the administrative appropriations and staff paid from the research and technological development appropriations serving in the Directorate-General for Industry, on the one hand, and in the Directorate-General for Telecommunications, Information Market and Exploitation of Research, on the other, shall be exercised by the Commission, the Member of the Commission responsible for personnel and administration, jointly if necessary with the Member of the Commission responsible for the Unified External Service, the Director-General for Personnel and Administration and the other Directors-General, and the Directors and Heads of Unit in the Directorates-General concerned, in accordance with the conditions laid down in Annex I.

Article 2

The powers conferred by the Staff Regulations on the appointing authority and by the Conditions of Employment of Other Servants on the authority responsible for concluding contracts of employment in respect of staff paid from the research and development appropriations other than those serving in the Directorate-General for Industry (III) or the Directorate-General for Telecommunications, Information Market and Exploitation of Research (XIII), shall be exercised by the Commission, the Member of the Commission responsible for personnel and administration, in agreement as appropriate with the Member of the Commission responsible for science, research and development, the Director-General for Personnel and Administration, the Director-General for Science, Research and Development and the Director-General of the Joint Research Centre, in accordance with the conditions laid down in Annex II.

Article 3

The powers delegated by Articles 1 and 2 to the Directors-General concerned shall be exercised, where they are unable act, by the Deputy Director-General with the most seniority in the highest grade. Where the Deputy Director-General is unable to act, these powers shall be exercised by the longest-serving official present or, in the event of equal length of service, by the eldest official in the highest category and grade.

Article 4

The Directors-General are authorised to delegate their powers to the Deputy Directors-General or to the Directors or to the Heads of Unit.
Such delegation of powers shall be published in an appropriate manner and shall be drawn to the attention of the staff.

Article 5

Should the persons to whom such powers are delegated be unable to act, they shall be replaced by the longest-serving official present or, in the event of equal length of service, by the eldest official in the highest category and grade.

Article 6

This Decision shall not apply to officials and other servants working in the Office for Official Publications of the European Communities.

Article 7

This Decision consolidates the provisions of the decisions listed in Appendix relating to the powers of the appointing authority or the authority responsible for concluding contracts of employment.

Article 8

This Decision repeals the Decisions of 20 November 1985 and 19 July 1989 on the exercise of the powers conferred by the Staff Regulations on the appointing authority.

Article 9

Annexes I and II form an integral part of this Decision.
