59-2005 OF 20 JULY 2005
GRADING UPON RECRUITMENT ON OR AFTER 1
MAY 2006(APPLICATION OF ARTICLE 13(1) OF ANNEX XIII OF THE STAFF
REGULATIONS)
This Administrative Notice only applies to new recruits who passed open
competitions the notice of which was published before 1 May 2004
and who have been recruited since 1 May 2006.
On 20 July 2005, the Appointing Authority published its commitment in
Administrative Notice (n° 59-2005)
to extend the effects of a possible future judgment by the Court of First
Instance (CFI) declaring Article 12(3) of Annex XIII of the SR illegal to
all officials whose grading was fixed on the basis of this article,
regardless of whether they have or have not contested their grading by
lodging a complaint pursuant to Article 90(2) of the SR and/or an appeal
to the CFI.
Article 12(3) of Annex XIII applied to recruitments which took place
between 1 May 2004 and 30 April 2006. As of 1 May 2006, new recruits are
graded on the basis of Article 13(1) of Annex XIII, which indicates that
the term "A*" has been replaced by the term "AD" and the terms "B*" and
"C*" by "AST".
Given the fact that Article 13(1) is in all respects identical to Article
12(3), and that this article simply renames the grades of recruitment, the
Appointing Authority confirms that the commitment set out in
Administrative Notice N° 59-2005
also covers the grading of officials recruited from lists of suitable
candidates resulting from competitions the notice of which was published
before 1 May 2004 and who were recruited after 30 April 2006, subject to
the same conditions as those set out in the previous Administrative
Notice. |
