Living conditions allowance (LCA) applicable in third countries

Article 10 of Annex X to the Staff Regulations

Under Annex 10(1) of Annex X to the Staff Regulations, an allowance for living conditions is fixed for officials, contract staff and temporary staff at each place of employment; it is reviewed and, where appropriate, adjusted each year by the appointing authority after the opinion of the Staff Committee has been obtained (see Commission Decision of 28 April 2004 on the exercise of powers conferred by the Staff Regulations on the appointing authority and by the Conditions of Employment of Other Servants on the authority responsible for concluding contracts of employment (Director General)).

Article 33(4) of the Treaty on the accession of the ten new Member States created a legal basis authorising the application of Annex X (rules applicable to staff working outside the Community) to be extended to officials remaining in post in the new Member States for a maximum period of fifteen months after accession. During that period, the officials concerned will continue to be eligible for the LCA fixed before accession.

An LCA will be paid to officials, contract staff and temporary staff of the European Communities serving in third countries and, for a maximum period of fifteen months after accession, to certain officials remaining in post in the ten new Member States at the following rates:

  • from 1 July 2004: Guyana (35%), Bolivia (25%), Malaysia (20%), Saudi Arabia (25%), Nepal (30%), Haiti (35%);
     
  • from 1 January 2005: El Salvador (15%), Honduras (15%).

Having regard to the Staff Regulations of officials of the European Communities and the conditions of employment of other servants of the Communities laid down by Regulation (EEC, Euratom, ECSC) No 259/68(2), as last amended by Regulation (EC, Euratom) No 857/2004(3), and in particular the first paragraph of Article 10 of Annex X thereto,
Having regard to the Treaty of Accession of the ten new Member States, and in particular Article 33(4) thereof,
Having regard to the Commission Decision of 28 April 2004 on the exercise of powers conferred by the Staff Regulations on the Appointing Authority and by the Conditions of Employment of Other Servants on the Authority Responsible for Concluding Contracts of Employment,



After consulting the Staff Committee and the Steering Committee for the External Service,

WHEREAS The relevant Commission departments have examined the results of the questionnaire on living conditions completed by the delegations, the ratings of the United Nations system of hardship allowances and other information available.
WHEREAS On 15 June 2004 the Technical Group proposed that the living conditions allowance for Guyana (35%), Bolivia (25%), Malaysia (20%), Saudi Arabia (25%), Nepal (30%) and Haiti (35%) be amended from 1 July 2004.
WHEREAS On 15 June 2004 the Technical Group proposed that the living conditions allowance for El Salvador (15%) and Honduras (15%) be amended from 1 January 2004,

THE APPOINTING AUTHORITY
HAS DECIDED AS FOLLOWS:

A living conditions allowance shall be paid, at the rate specified for their place of employment in the Annex, to officials, contract staff and temporary staff of the European Communities assigned to postings outside the European Union and, for a maximum of fifteen months following the date of accession, to officials still posted in the ten new Member States.
