Allowance for living conditions (LCA)
in countries outside the European Union
(Article 10 of Annex X to the Staff Regulations)
In accordance with Article 10(1) of Annex X to the Staff Regulations,
an allowance for living conditions is fixed according to the place of
employment of officials contract staff and temporary staff. The Appointing
Authority must review that allowance each year and, where appropriate,
adjust it after obtaining the opinion of the Staff Committee.
In accordance with Article 33(4) of the Treaty on the accession of the ten
new Member States a legal basis was created to authorise the extension of
the application of Annex X of the Staff Regulations (rules applicable to
staff working outside the Community) to officials remaining in post in the
new Member States for a maximum period of fifteen months after accession.
During this period these officials shall continue to benefit from the LCAs
fixed before accession.
On 20 December 2004 the AIPN adopted a decision fixing the LCAs for these
countries from 1 January 2005.
The rates for the LCAs of these places of employment are set out in the
table at annex.
The attention of staff is drawn to the valuations for five places of
employment (Australia, Bulgaria, Croatia, New Caledonia and New Zealand)
which are under negotiation with staff representatives concerning a
retrospective reduction in the LCA rate effective from 1 January 2005. The
decision of the AIPN will be taken at the 2005 mid-term review.

proposals have been made by the Medical Service, the DG RELEX
security office and the department in charge, and an opinion expressed
by the technical group of 15 October 2004 concerning the evaluation by
the AIPN of the allowance for living conditions set annually for each
place of employment. |
THE APPOINTING AUTHORITY
HAS DECIDED AS FOLLOWS: Officials, contract staff and temporary staff of the European Communities
assigned to postings outside the European Union and certain officials
remaining in post in the ten new Member States for a maximum period of
fifteen months after accession shall be paid a living-conditions allowance
at the rate specified for their place of employment in the Annex.
