At its 241st meeting, held on 7 April 2005, the College of the Heads of Administration approved Conclusion 236/05 (see annex), which is applicable within the Commission from 1 May 2005.

AT THEIR 241st MEETING ON 7 APRIL 2005

 

Subject:      Application of Article 2(4) of Annex VII to the Staff Regulations (person treated as a dependent child) where the official is on leave on personal grounds
 
The Heads of Administration hereby agree that a person should continue to be treated as a dependent child under Article 2(4) of Annex VII to the Staff Regulations when the official concerned is on leave on personal grounds (Article 40 of the Staff Regulations) and should cease to be so treated only on expiry of the period in respect of which the decision to treat the person concerned as a dependent child was adopted.

No application to treat a person as a dependent child or to extend the period during which a person is to be treated as a dependent child shall be granted during a period of leave on personal grounds.

The same principles shall apply by analogy to temporary staff and contract staff who are granted unpaid leave on compelling personal grounds pursuant to Article 17 and Article 91 respectively of the Conditions of Employment of Other Servants.

This Conclusion shall apply from 1 May 2005.

It replaces Conclusion 100/84 approved by the Heads of Administration at their 149th meeting on 6 April 1984.
