At its 241st meeting, held on 7 April 2005, the College of the Heads of Administration approved Conclusion 237/05 (see annex), which is applicable within the Commission from 1 May 2005.

CONCLUSION 237/05

APPROVED BY THE HEADS OF ADMINISTRATION
AT THEIR 241st MEETING ON 7 APRIL 2005

Subject:       Education allowance as referred to in Article 3(1) of Annex VII to the Staff Regulations Interpretation of the concept of regular full time attendance at an education establishment (first subparagraph)
  1. The Heads of Administration regard the requirement of “full time” attendance at a primary or secondary school or establishment of higher education, which is applicable, pursuant to the first subparagraph of Article 3(1) of Annex VII to the Staff Regulations, for the purposes of entitlement to the education allowance, as satisfied:
     
    • (a) automatically if the pupil or student is given 16 hours of tuition and/or practical work weekly at the education establishment; or,
       
    • (b) where the pupil or student is given less than 16 hours of tuition and/or practical work weekly, both of the following conditions are met:

      the studies are part of a complete course, i.e. their purpose is recognised by the State,

      and

      the pupil or student follows the standard timetable specified for that type of studies.
       

  2. The Heads of Administration regard the requirement of “regular” attendance at a primary or secondary school or at an establishment of higher education as satisfied if the attendance of the pupil or student is for a period of studies of at least three months.

    This Conclusion shall apply from 1 May 2005.

    It replaces Conclusion 166/87, which was approved by the Heads of Administration at their 160th meeting on 15 January 1987.
