repealing some general implementing provisions of the Staff Regulations of officials of the European Communities and the Conditions of Employment of other servants of the European Communities

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Staff Regulations of officials of the European Communities (hereinafter referred to as the Staff Regulations) and the Conditions of Employment of other servants of the European Communities laid down by Council Regulation (EEC, Euratom, ECSC) No 259/68⁽¹⁾ ,

Having regard to the Opinion of the Staff Regulations Committee,

Having consulted the Staff Committee,

Whereas:

1. Council Regulation (EC, Euratom) No 723/2004 of 22 March 2004⁽²⁾ introduces with effect from 1 May 2004 significant changes to the Staff Reguations and Conditions of Employment of other servants of the European Communities. These amendments relate, inter alia, to the areas covered by the General Implementing Provisions for Giving Effect to Articles 67 and 68 of the Staff Regulations and Articles 1, 2 and 3 of Annex VII thereto, adopted by the Commission on 11 February 1985⁽³⁾ , as regards family allowances, and the General Provisions for Giving Effect to Article 2(4) of Annex VII to the Staff Regulations (persons to be treated as dependent children), adopted by the Commission on 12 December 1996⁽⁴⁾ . New provisions have been adopted in these areas as a result.
    
2. For reasons of clarity and legal certainty, the general implementing provisions, which have now become obsolete, should be expressly repealed,

HAS DECIDED AS FOLLOWS:

Article 1

The General Implementing Provisions for Giving Effect to Articles 67 and 68 of the Staff Regulations and Articles 1, 2 and 3 of Annex VII thereto, adopted by the Commission on 11 February 1985 and the General Provisions for Giving Effect to Article 2(4) of Annex VII to the Staff Regulations, adopted by the Commission on 12 December 1996, are hereby repealed.

Article 2

These provisions shall take effect on the day after their adoption.
