At their 242nd meeting, on 16 June 2005, the Heads of Administration
approved Conclusion 238/05 (see Annex) which applies within the Commission
from 1 May 2004.

(Article 2 of Annex XIII to the Staff Regulations) |
Where a grade after 1 May 2004 comprises more steps than the equivalent
grade before that date, an official who on 30 April 2004 was classified in
the last step of such a grade shall be deemed to have acquired seniority
in that step before 1 May 2004 for the purposes of advancement of step
pursuant to Article 44 of the Staff Regulations.
Seniority of step acquired before 1 May 2004 shall be taken into account
in the limit of 24 months.
Examples:
- An official who reached the 4th step of grade B5 (which became
grade B*5 on 1 May 2004) on 1 January 2003 reaches the 5th step of that
same grade with effect from 1 January 2005. He/she is deemed to have at
the latter date two years’ seniority in a step in his grade, pursuant to
the first paragraph of Article 44 of the Staff Regulations.
- Where an official has been in the 4th step of grade B5 since 1
January 2000 and therefore has at 1 May 2004 a seniority of 52 months in
that step, this is taken into account as 24 months. He/she therefore
reaches the 5th step of grade B*5 on 1 May 2004.
This conclusion shall apply from 1 May 2004.
