CONCLUSION 241/05

APPROVED BY THE HEADS OF ADMINISTRATION
AT THEIR 243^rd MEETING, ON 6 OCTOBER 2005

The first paragraph of Article 4 of Annex IVa to the Staff Regulations lays down that “… officials aged over 55 authorised to work half-time in preparation for retirement shall receive a reduced basic salary equal to the higher of the two amounts obtained by applying the following percentages to the full-time basic salary:

1. either 60%
    
2. or the percentage corresponding to years of service within the meaning of Articles 2, 3, 4, 5, 9 and 9a of Annex VIII at the beginning of the period of half-time work, plus 10%.”

So as to leave no doubt about the interpretation of the above provisions, the Heads of Administration agree that, in calculating the percentage referred to in (b), years of pensionable service acquired by officials under Article 11(2) and (3) of Annex VIII to the Staff Regulations shall not be taken into account.

This conclusion shall apply from 1 November 2005.
