Termination of service - compensation paid for leave not
taken
This Administrative Notice applies to the officials and other
servants who leave the service and have not used up their annual leave
entitlement.
The Conclusion approved by the Heads of Administration states that the
compensation is subject to the special levy (Art. 66a of the Staff
Regulations) which affects remuneration paid by the Communities to staff
in active employment.
This compensation constitutes part of the remuneration relating to a
period during which the official or other servant was in active
employment.

At its 246th meeting, on 19 October 2006, the College of the Heads of
Administration approved Conclusion 250/06 (see Annex), which shall apply
within the Commission from 1 November 2006.

Applicability of the special levy to the
compensation paid for leave not taken |
Article 66a(1) of the Staff Regulations states that “a temporary
measure regarding remuneration paid by the Communities to staff in
active employment, to be known as the “special levy”, shall be applied
from 1 May 2004 to 31 December 2012”.
For the purposes of applying this provision, the compensation paid at
the time of leaving the service to an official who has not used up all
his annual leave constitutes part of the remuneration relating to a
period during which the official was in active employment.
Consequently, this compensation is subject to the special levy under the
conditions laid down in Article 66a of the Staff Regulations.
This Conclusion shall apply from 1 November 2006.
