At their 251st meeting, on 14 February 2008, the Heads of
Administration approved Conclusion 253/08, which applies within the
Commission from 1 March 2008.

rights acquired as a member of the temporary staff
(Article 28 of Annex XIII to the Staff Regulations) |
- Article 28 of Annex XIII to the Staff Regulations provides that
members of the temporary staff who were under contract on 1 May 2004
and are appointed as officials after that date shall, on retirement,
be entitled to an actuarial adjustment of the pension rights they
acquired as temporary servants which takes into account the change
in their pensionable age within the meaning of Article 77 of the
Staff Regulations.
- Article 22(1) of Annex XIII specifies the age at which officials
who entered the service before 1 May 2004 are entitled to a
retirement pension.
- Article 1(1) of the Annex to the Conditions of Employment of
Other Servants stipulates that the provisions of Annex XIII apply by
analogy to other servants employed on 30 April 2004.
- In the light of the above provisions and on the basis of the
study carried out by the Statistical Office of the European
Communities (EUROSTAT), the table below establishes the actuarial
adjustment to be made under Article 28 of Annex XIII, according to
the age of the official on 1 May 2004.
CONCLUSION
The actuarial adjustment provided for in Article 28 of Annex XIII to the
Staff Regulations shall be carried out by applying the coefficient
corresponding to the age of the official on 1 May 2004 according to the
following table:
