Notice of election

The Electoral Office, the membership of which is given in Annex 1, is issuing the following notice of election in accordance with Article 5 of the Procedure for election of the Brussels Local Staff Committee (hereinafter “Electoral Rules”), confirmed by the general meeting on 20 February 2006.

1. Date, time and place of elections

The dates for the election of the Brussels Local Staff Committee, as determined by the general meeting, are 9th, 10th and 11th June 2009.

If a quorum of two thirds has not been reached after these three days, the electoral period will automatically be extended by 10 working days, from 12th to 25th June 2009 (Article 14 of the Electoral Rules).

Each elector may vote once only and the vote is anonymous.

Voting will be electronic, except in the case of postal votes (see 4 below). Access to electronic voting will be guaranteed only in the case of PCs connected to the Commission’s internal network, at locations where staff are represented by the Brussels Section of the Staff Committee (i.e. PCs installed in Commission offices or supplied to distance workers with a secure access using token/digipass).

Staff who will be away from their place of employment throughout the period covered by the elections and who are not certain that they will have access to electronic voting (e.g. from delegations in non member countries) should apply for a postal ballot paper.

Electronic voting will be possible from 09:00 on 9th June 2009 until 17:30 on 11th June 2009 (Brussels time).

Irrespective of the place of employment of electors who are represented by the Brussels Local Staff Committee, postal votes must reach the Electoral Office by 17.30 on 11th June 2009 (Brussels time).

2. Entitlement to vote

The electoral roll was published on 1st April 2009 on IntraComm. It was also brought to the attention of the officials and other servants employed elsewhere than in Brussels.

Members of staff shall be entitled to vote if their name appears on the electoral roll and, on 16th March 2009, they were:

  • officials of the institution or
     
  • other servants(1) whose contract is for one year or more or for an indefinite period, and those whose contract is for less than one year, provided that, on the reference date (16/03/2009), they had been serving for six months or more, as indicated by the Administration in the introduction to the electoral roll published on IntraComm on 1er April 2009,

    and are serving in:
     
    • a Commission department in Brussels;
       
    • a representation or delegation in the European Union (but not in France or Luxembourg);
       
    • the Veterinary Office in Grange (DG SANCO).

In this connection, the Electoral Office wishes to draw the staff’s attention to Article 4 of the Electoral Rules, which states that: “objections concerning the electoral roll shall be lodged in writing with the Director General for Personnel and Administration no later than eight working days after the electoral roll is published”.

The electoral roll was published on 1st April 2009, as a consequence of which the deadline for lodging an objection was 16 April 2009. Objections, if any, must be lodged using only the operational mailbox “ADMIN ELECTIONS CLP BXL”.

The electoral roll will be completed, declared final, and published by the Administration within the period allowed under Article 4 of the Electoral Rules. The staff concerned will be allowed to cast their votes solely on that basis.

3. Voting procedure

Votes shall be cast:

  • either by means of the specific program to which electors will have access via a professional PC connected to the Commission’s internal network (see 1 above);
     
  • or by postal vote (subject to the requirements set out at 4 below).

Votes may not be cast by any other means.

Voting: votes must be cast as follows:

  1. either a vote for a list: a mark (in the case of electronic voting) or a cross (in the case of a postal vote) should be placed in the box beneath the number and abbreviation of the list chosen (list vote);
     
  2. or a vote for a maximum of 27 pairs of candidates (full members and alternates) chosen from one or more lists. A mark (in the case of electronic voting) or a cross (in the case of a postal vote) should be placed in the box opposite the names of each pair of candidates chosen, up to a maximum of 27 pairs of candidates (preference vote).

A ballot paper or form bearing both a cross against a list (“list vote”) and one or more crosses against the names of candidates (“preference votes”) on the same list shall invariably be treated as a preference vote.

A ballot paper (i.e. a postal vote) bearing both a cross against a list (“list vote”) and one or more crosses against the names of candidates on one or more other lists shall be declared void. The electronic system does not allow the ballot form to be completed in this way.

4. Postal votes

Electors who, because they will be on mission, leave, etc., will be unable to vote electronically on 9th, 10th and 11th June 2009 may submit to the President of the Electoral Office (SC11/ 2-21) a signed statement of reasons, accompanied by a photocopy of their staff card, asking for a ballot paper to be mailed to them by mail or by internal mail before 17:30 on 20th May 2009.

After being duly completed, the ballot papers must reach the President of the Electoral Office (SC11/ 2-21) no later than 17.30 (Brussels time) on 11 June 2009.

Postal votes must be sent inside three envelopes.

  • The innermost envelope (sealed) must contain the ballot paper and be unmarked. It will be placed in the ballot box provided for this purpose at the premises of the Electoral Office;
     
  • The middle envelope must bear the personnel number, name and signature of the elector, and will be attached to the electoral roll;
     
  • The outer envelope must bear the name and address of the President of the Electoral Office: Mr Durante Rapacciuolo, (SC11/ 2-21), European Commission, B 1049 Brussels.

Ballot papers bearing any writing, signature, erasure or mark other than as provided for at 3 above or completed using ink of a colour other than black or blue will be declared void.

5. Nomination of candidates

Nominations must combine a candidate for full membership and a candidate for alternate membership. They must be submitted both:

  • in writing (paper format, kept as an official record) to the Electoral Office (SC11/ 2-21)

    or
     
  • electronically, to the “ADMIN ELECTIONS CLP BXL” operational mailbox

no later than 17.30 (Brussels time) on 5th May 2009.

They must be in the form of a list containing no more than 27 nominations.

The nomination must indicate the personnel number and administrative status of each candidate.

No candidate may be nominated on more than one list.

Each list must bear the signature of the candidate for full membership whose name appears first. For the purpose of checking nominations (Article 7 of the Electoral Rules), the Electoral Office asks that each list be accompanied by a declaration of acceptance by each candidate for full or alternate membership.

The order in which the candidates appear on their list shall be determined by the trade union or staff association concerned.

A meeting between the Electoral Office and the candidates whose names appear first on their list shall be held on 8th May 2009 at the latest. The list numbers shall be drawn by lot in the course of the meeting.

6. Actions or behaviour which may serve to disrupt the proper conduct of the elections

The Electoral Office would point out that any person who acts or behaves in a way which is likely to disrupt the proper conduct of the elections may be subject to the disciplinary proceedings applicable in the case of infringements of the provisions of Title II of the Staff Regulations of Officials of the European Communities, without prejudice to any legal proceedings which may be brought in the light of the rules in regard to jurisdiction.

7. Further information

The Electoral Office reserves the right to communicate to the staff, by means of Administrative Notices, in particular via IntraComm and e mails addressed to everyone, any additional information essential to the successful conduct of the elections.
