EXCEPTIONAL TAX ON INCOME IMPOSED BY THE GREEK AUTHORITIES

LEGAL ASSISTANCE

This Administrative Notice is intended for officials and former officials having declared their Commission salary or pension in 2008 to the tax authorities in Greece and now being requested by the Greek authorities to pay an exceptional tax on that income.

In a previous Administrative Notice, No. 55-2009 of 3 August 2009, the officials and former officials concerned by this tax were informed that the Commission is ready to assist them to consult a specialised lawyer and that more detailed information on the kind of assistance would be published shortly.

The Commission is now in a position to provide those concerned with the following information:

On 31 July 2009, the Commission reacted favourably to a request for assistance, based on Art.24 Staff Regulations, submitted in connection with this matter by a retired official who is a member of the Association of Former Officials of the European Communities (AIACE) – Greek Section.

Given the importance of this case and its potential implications, and also to ensure equal treatment in similar cases, the Commission has identified a law firm specialising in Greek tax law which will assist AIACE's members, as well as other officials and former officials who are affected by the recent tax measures imposed by the Greek Government.

In order to facilitate the defence of this case with the Greek tax authorities and, if need be, the Greek judiciary, all officials and former officials having received an invitation to pay the exceptional tax calculated taking into account their Community salary or pension and who want to avail themselves of the Commission’s assistance are asked to notify the Commission and provide a copy of the relevant tax bill, it being understood that the protection of their personal data will be guaranteed.
