Redistribution of responsibilities within DG ADMIN
The decision of the Director-General for Personnel and Administration
attributing responsibilities within DG ADMIN from 1 October 2006 following
reorganisation of the Directorate-General is set out below.
As the Director-General of DG ADMIN is empowered to adopt certain acts
concerning staff management, this decision concerns all Commission
officials and other servants, apart from local staff. It establishes who
(the Director-General himself or within DG ADMIN’s departments) has the
authority to adopt
– decisions provided for by the Staff Regulations in respect of officials
(these decisions are taken by the Appointing Authority);
– decisions provided for by the Conditions of Employment of Other Servants
in respect of temporary, auxiliary and contract staff and special
advisers (these decisions are taken by the Authority Responsible for
Concluding Contracts of Employment).
DECISION
OF THE DIRECTOR-GENERAL FOR PERSONNEL AND ADMINISTRATION
ON
THE EXERCISE OF THE POWERS CONFERRED ON THE APPOINTING AUTHORITY AND THE
AUTHORITY RESPONSIBLE FOR CONCLUDING CONTRACTS OF EMPLOYMENT
The Director-General for Personnel and Administration,
Having regard to the Commission decision of 16 June 2005(1),
as last amended by the decision of 13 June 2006(2),
on the exercise of the powers conferred by the Staff Regulations on the
Appointing Authority and by the Conditions of Employment of Other Servants
on the Authority Responsible for Concluding Contracts of Employment
(“Appointing Authority Decision”), and in particular the first paragraph
of Article 5 thereof,
Whereas:
- In that the decision of the Director-General for Personnel and
Administration reorganising the departments of DG ADMIN enters into
force on 1 October 2006, it is necessary to amend the currently
applicable decision of the Director-General for Personnel and
Administration subdelegating the powers conferred by the Staff
Regulations on the Appointing Authority and by the Conditions of
Employment of Other Servants on the Authority Responsible for Concluding
Contracts of Employment.
- By decision of 12 May 2006, the Director-General for Personnel and
Administration subdelegated the powers conferred on him by the
Appointing Authority Decision relating to transfer to posts for attested
officials. In the interests of clarity, the provisions concerning the
subdelegation of the Director-General of DG ADMIN's powers should be
recast in a single text,
Has adopted this decision:
Article 1
The powers delegated to the Director-General for Personnel by
Commission decision C(2005) 1792 of 16 June 2005 as amended shall hereby
be subdelegated to the Directors and Heads of Unit of the
Directorate-General for Personnel and Administration as shown in the
Annex
hereto.
Article 2
The decisions of 20 October 2005(3)
and 12 May 2006 of the
Director-General for Personnel and Administration subdelegating the powers
conferred by the Staff Regulations on the Appointing Authority and by the
Conditions of Employment of Other Servants on the Authority Responsible
for Concluding Contracts of Employment shall hereby be repealed.
Article 3
This decision shall enter into force on 1 October 2006.
