Distribution of responsibilities within DG HR

– Rectification –

By decision of 3 February 2010¹ the Director-General of the Directorate-General Human Resources and Security (DG HR) has laid down competences of services inside DG HR to exercise powers of Appointing Authority and of Authority Responsible for Concluding Contracts of Employment.

The decision published hereafter corrects a number of erroneous indications in the tables attached to the earlier decision to bring them into line with established workflows in DG HR.

For informational purposes and for ease of reference the rectified tables are also published once again in full.

DECISION
OF THE DIRECTOR-GENERAL FOR HUMAN RESOURCES AND SECURITY
RECTIFYING HER DECISION OF 3 FEBRUARY 2010 ON
THE EXERCISE OF THE POWERS CONFERRED ON THE APPOINTING AUTHORITY AND THE AUTHORITY RESPONSIBLE FOR CONCLUDING CONTRACTS OF EMPLOYMENT

The Director-General for Human Resources and Security,

Having regard to Article 2(1) of the Staff Regulations of Officials of the European Union,

Having regard to Article 6 of the Conditions of Employment of Other Servants,

Having regard to the Commission Decision of 30 November 2007², as last amended by the Decision of 19 January 2010³, on the exercise of the powers conferred by the Staff Regulations on the Appointing Authority and by the Conditions of Employment of Other Servants on the Authority Responsible for Concluding Contracts of Employment (“Appointing Authority Decision”), and in particular the first paragraph of Article 5 thereof,

Whereas:

1. With effect from 3 February 2010 the exercise of the powers of Appointing Authority and of Authority Responsible for Concluding Contracts of Employment has been redistributed within the Directorate-General Human Resources and Security (DG HR).
    
2. A number of clerical errors have been detected in the Annex to the Decision of 3 February 2010. These errors need to be rectified so that the decision will reflect established workflows within DG HR,

Has adopted this decision:

Article 1

The Annex to the Decision of the Director-General for Human Resources and Security of 3 February 2010⁴ is modified as follows:

1. In Table I (Filling posts), line 3 – first indent –, the unit number "B.4" is replaced by unit number "B.2", and in lines 6 and 7 the unit number "B.4" is deleted.
    
2. In Table II (Recruitment), the footnote is deleted.
    
3. In Table III (Career), line 3, the unit number "HR.B.4" is replaced by the unit number "HR.B.2".
    
4. In Table III (Career), line 5, the sentence
   "In the case of a Cabinet member (ADM, AST -ex-A*, B*, C*, D*) or a spokesperson: this power is subdelegated to the Director of HR.A, with notification of the President's Cabinet."
   is replaced by the sentence
   "In the case of a Cabinet member (ADM, AST -ex-A*, B*, C*, D*) or a spokesperson: this power is subdelegated to the Director of HR.B, with notification of the President's Cabinet."
    
5. In Table IV (Termination of service), footnote 1, the following sentence is added:
   "As regards CU, terms and procedure under Commission Decision C(2008)5028/2 apply."
    
6. In the English language version of Table VI (Discipline), line 2, the words "Report on" are replaced by the words "Postponement of".
    
7. In Table VII (Working Conditions), line 5, line 6 – first indent –, line 10 – first indent – and line 12, in each case the unit number "HR.B.5" is replaced by the unit number "HR.B.1".
    
8. In Table VIII (Pay and Social Benefits), line 9, the unit number "HR.A.5" is replaced by the unit number "HR.A.2".
    
9. In Table XI (Temporary Staff), line 1 – last indent –, line 2 – last indent – and line 19 – last indent –, in each case the sentence
   "In the case of a member of a Cabinet, a member of BEPA or a spokesperson: this power is subdelegated to the Director of HR.A, with notification of the President's Cabinet."
   is replaced by the sentence
   "In the case of a member of a Cabinet, a member of BEPA or a spokesperson: this power is subdelegated to the Director of HR.B, with notification of the President's Cabinet."

Article 2

Individual decisions taken since 3 February 2010 by an official as Appointing Authority or as Authority Responsible for Concluding Contracts of Employment in fields of responsibility assigned to him or her pursuant to Article 1 of the present decision are hereby confirmed.

Article 3

This decision shall enter into force immediately.
