Distribution of responsibilities within DG HR

The decision of the Director-General for Human Resources and Security attributing responsibilities within DG HR for staff matters (in DG HR and in other Commission services) is published below. This decision follows the renaming of the previous DG ADMIN and the reorganisation of the service as from 1 January 2010. It will be revised again once a new Commission decision on the delegation of Appointing Authority powers, which is under preparation, has been adopted.

As the Director-General of DG HR is empowered to adopt certain acts concerning staff management, this decision concerns all Commission officials and other servants, apart from local staff. It establishes who (the Director-General, a Director or a Head of Unit within DG HR) has the authority to adopt

  • decisions provided for by the Staff Regulations in respect of officials (these decisions are taken by the Appointing Authority);
  • decisions provided for by the Conditions of Employment of Other Servants in respect of temporary and contract staff and special advisers (these decisions are taken by the Authority Responsible for Concluding Contracts of Employment).

While the decision published hereinafter was in the process of being adopted, the Commission enacted another amendment to its decision on Appointing Authority powers mentioned in the third citation. The updated reference is "the Commission Decision of 30 November 2007, as last amended by the Decision of 19 January 2010", C(2010)184, Administrative Notice No 13-2010 of 9 February 2010.

DECISION
OF THE DIRECTOR-GENERAL FOR HUMAN RESOURCES AND SECURITY
ON
THE EXERCISE OF THE POWERS CONFERRED ON THE APPOINTING AUTHORITY AND THE AUTHORITY RESPONSIBLE FOR CONCLUDING CONTRACTS OF EMPLOYMENT

The Director-General for Human Resources and Security,

Having regard to Article 2(1) of the Staff Regulations of Officials of the European Communities,

Having regard to Article 6 of the Conditions of Employment of Other Servants,

Having regard to the Commission Decision of 30 November 2007(1), as last amended by the Decision of 29 April 2009(2), on the exercise of the powers conferred by the Staff Regulations on the Appointing Authority and by the Conditions of Employment of Other Servants on the Authority Responsible for Concluding Contracts of Employment (“Appointing Authority Decision”), and in particular the first paragraph of Article 5 thereof,

Whereas:

  1. With effect from 1 January 2010 the Directorate-General Personnel and Administration has been renamed Directorate-General Human Resources and Security (DG HR).
     
  2. With effect from the same day a new organisation chart of DG HR has been implemented.
     
  3. It is therefore necessary to recast the currently applicable decision of the Director-General for Personnel and Administration subdelegating the powers conferred by the Staff Regulations on the Appointing Authority and by the Conditions of Employment of Other Servants on the Authority Responsible for Concluding Contracts of Employment,

Has adopted this decision:

Article 1

The powers delegated to the Director-General for Personnel and Administration by Commission Decision C(2007) 5730 of 30 November 2007 as amended are hereby subdelegated to the Directors and Heads of Unit of the Directorate-General Human Resources and Security as shown in the Annex hereto.

Article 2

The decision of 1 February 2007 (3) of the Director-General for Personnel and Administration subdelegating the powers conferred by the Staff Regulations on the Appointing Authority and by the Conditions of Employment of Other Servants on the Authority Responsible for Concluding Contracts of Employment is hereby repealed.

Article 3

This decision shall enter into force immediately.
