Distribution of responsibilities within DG HR
– Amendment –
By decision of 3 February 2010(1)
the Director-General of the Directorate-General Human Resources and
Security (DG HR) has laid down competences of services inside DG HR to
exercise powers of Appointing Authority and of Authority Responsible for
Concluding Contracts of Employment.
The decision published hereafter amends Article 1 of the Decision
mentioned above. The Annex to the Decision of 3 February 2010 remains
unchanged.
DECISION
OF THE DIRECTOR-GENERAL FOR HUMAN RESOURCES AND SECURITY
AMENDING HER DECISION OF 3 FEBRUARY 2010 ON
THE EXERCISE OF THE POWERS CONFERRED ON THE APPOINTING AUTHORITY AND THE
AUTHORITY RESPONSIBLE FOR CONCLUDING CONTRACTS OF EMPLOYMENT
The Director-General for Human Resources and Security,
Having regard to Article 2(1) of the Staff Regulations of Officials of the
European Union,
Having regard to Article 6 of the Conditions of Employment of Other
Servants,
Having regard to the Commission Decision of 30 November 2007(2),
as last amended by the Decision of 19 January 2010(3),
on the exercise of the powers conferred by the Staff Regulations on the
Appointing Authority and by the Conditions of Employment of Other Servants
on the Authority Responsible for Concluding Contracts of Employment
(“Appointing Authority Decision”), and in particular the first paragraph
of Article 5 thereof,
Whereas:
- With effect from 3 February 2010 the exercise of the powers of
Appointing Authority and of Authority Responsible for Concluding
Contracts of Employment has been redistributed within the
Directorate-General Human Resources and Security (DG HR).
- In order to further improve the continuity of workflows within DG
HR, it needs to be clarified that the competences delegated to an agent
can be exercised at any moment by the hierarchical superiors of the
agent concerned.
- In accordance with standing practice, it should also be clarified
that in the event of a recast of the Commission Decision delegating
powers of Appointing Authority and of Authority Responsible for
Concluding Contracts of Employment to Commission services the present
subdelegation decision continues to apply to delegations given to the
Director General of DG HR,
Has adopted this decision:
Article 1
Article 1 of the Decision of the Director-General for Human Resources
and Security of 3 February 2010(4)
is replaced by the following:
"Article 1
- The powers delegated to the Director-General for Personnel by
Commission Decision C(2007) 5730 of 30 November 2007 as amended are
hereby subdelegated to the Directors and Heads of Unit of the
Directorate-General Human Resources and Security as shown in the Annex
hereto.
- The powers thus subdelegated to a Director or to a Head of Unit can
be exercised at any time by a hierarchical superior of the agent
concerned.
- In the event of a recast of the Commission Decision C(2007)5730
subdelegations enacted by the present decision shall continue to apply
to delegations given to the Director General for Human Resources and
Security. "
Article 2
This decision shall enter into force immediately.
